Product Notice

FOR BOXPLUNGE PRODUCTS

By accessing, purchasing, installing, or using any BoxPlunge product (“Product”), you (hereinafter “you” or “User”) acknowledge that you have read, understood, and agree to be bound by all terms set forth in this Product Notice and the accompanying Terms of Sale & Conditions. If you do not accept these terms, do not use or continue to use the Product.

  1. ASSUMPTION OF RISK AND RESPONSIBILITY
    User Responsibility:

    • You are solely responsible for understanding the proper installation, operation, and maintenance of this Product, including all warnings and safety instructions provided by BoxPlunge, its User Manual, and local building or safety regulations.

    • You agree to assume all risks associated with the use and misuse of this Product, including any resulting personal injury, death, or property damage.

    Competent Supervision Required:

    • This Product should be used only by individuals who are competent, responsible, and capable of following all safety instructions, or under the direct supervision of such individuals.

    • If you are unwilling or unable to accept full responsibility for the risks and requirements associated with this Product, do not use the Product.

    Health Conditions and Age Restrictions:

    • Not for use by persons under 18 years of age.

    • Not for use by persons with underlying heart or neurological conditions without explicit medical clearance.

    • Individuals with health conditions (e.g., heart disease, circulatory problems, diabetes, blood pressure issues, epilepsy, respiratory conditions, open wounds, or pregnancy) must consult a physician before use.

    • Elderly users or users under the influence of substances (alcohol, drugs, or medication) should seek medical advice and exercise extreme caution.

  2. INSTALLATION AND ELECTRICAL SAFETY
    Local Building Codes:

    • You must comply with all applicable building codes, regulations, and permits when installing or operating the Product.

    Ground-Fault Circuit Interrupter (GFCI) Protection:

    • The Product must be installed on a dedicated GFCI-protected circuit (or equivalent ground-fault protection device) in accordance with national and local electrical codes.

    • Always use a GFCI breaker to protect against the risk of electrical shock.

    Dry Locations for Power:

    • Position power plugs and electrical connections in a dry area, away from water sources such as sprinklers, rain, or flood-prone locations.

    High Voltage Warning:

    • DANGER – RISK OF ELECTROCUTION: The chiller and associated components involve high voltage. Disconnect the main power supply before cleaning or performing maintenance.

    • Never cut or modify the power plug. This could cause serious injury or death.

    • Do not open or disassemble the pump housing or electrical components unless specifically instructed in the User Manual.

    Immediate Power Disconnection:

    • If you observe any abnormal water leakage or potential flooding near the electrical components, immediately unplug the Product from its power source.

    • Do not use the Product if the cord or plug is wet or if they show any sign of damage.

    Cord and Plug Safety:

    • Do not pull on the power cord to remove the plug from the outlet.

    • Keep plugs off the floor and away from areas where water may accumulate.

    Flooding Hazards and Liability:

    • Flooding Risk: Improper installation, damage to hoses or fittings, or water overflow can lead to flooding, property damage, and electrical hazards.

    • You are responsible for taking all reasonable measures (e.g., checking for leaks, securing fittings, using water alarms, installing drainage) to prevent flooding.

    • BoxPlunge disclaims any liability for property damage or mold resulting from flooding.

  3. WATER SANITATION AND MAINTENANCE
    User’s Duty to Maintain Water Quality:

    • The User is responsible for keeping the water clean and monitoring water chemistry (if chemicals are used).

    • If no chemicals are used, change the water at least twice per month or as otherwise recommended in the User Manual.

    • If chemicals are used, maintain proper levels to ensure safe water conditions.

    • Filters should be replaced at least twice per month (or per User Manual instructions).

    Ozone Generator Precautions:

    • Some units include an ozone generator. Ozone gas can be irritating if inhaled. Operate in a well-ventilated area and ensure no person or pet enters the treatment area until at least 30 minutes after an ozone cycle ends.

    • WARNING: High levels of ozone may lead to respiratory irritation and other symptoms.

    Professional Servicing:

    • Have a certified professional periodically inspect and maintain your BoxPlunge tub to ensure all components remain in good, safe working condition.

  4. RISK OF DROWNING AND PERSONAL INJURY
    DANGER – DROWNING HAZARD

    • Children are at significant risk. Never leave children unattended near or in the cold plunge.

    • Keep the cover on when not in use. Covers are not fail-proof; they discourage unauthorized access but do not guarantee safety.

    • Impaired or inexperienced users must be supervised.

    Influence of Alcohol or Drugs:

    • Using the Product while under the influence of alcohol, drugs, or medication can severely impair judgment and coordination, increasing the risk of drowning or injury. Do not use under these conditions.

    Entering and Exiting the Tub:

    • Cold water can cause gasp reflex and lightheadedness. Enter and exit slowly to avoid slipping or sudden shock.

    CPR Knowledge:

    • It is strongly recommended that users learn CPR (Cardiopulmonary Resuscitation) to provide immediate assistance in case of an emergency.

  5. ELECTRIC SHOCK PRECAUTIONS (EXTENDED)
    Minimum Clearance:

    • Install at least 5 feet (1.5 m) away from all other objects, walls, metal surfaces, or electrical appliances.

    • No electrical appliance of 12 VDC or more (e.g., lights, telephones, radios, TVs) may be placed within 5 feet (1.5 m) of the BoxPlunge tub.

    Circuit Breaker and Shut-Off:

    • The Product must include a circuit breaker or suitable disconnecting means readily accessible and visible to the tub user but located at least 5 feet (1.5 m) from the water.

    • Always unplug before performing any servicing.

    IMPORTANT – UNPLUG BEFORE USE:

    • You must always unplug the filtration syste (including any submersible pump) and freezer (if applicable) before any user enters the water.

    • Although the Product may come equipped with a safety system disconnect designed to de-energize both hot and neutral wires, this system has NOT been third-party tested.

    • To ensure the highest level of safety, do not rely solely on the safety system disconnect; physically unplug the power cord prior to use.

    Severe Weather and Flooding Events:

    • During storms or flood conditions, shut off and disconnect the Product to avoid potential electrocution or short-circuit.

    • If the area floods, ensure a qualified electrician inspects the unit before re-energizing.

  6. COLD WATER IMMERSION HAZARDS
    WARNING – RISK OF HYPOTHERMIA

    • Prolonged immersion below 37°F (2.8°C) can lead to hypothermia, which may result in unconsciousness, organ failure, and potentially death.

    • First-time users should limit cold water immersion to 1 minute; experienced users should limit to 10 minutes.

    Medication and Substance Use:

    • Alcohol, anticoagulants, antihistamines, vasoconstrictors, vasodilators, stimulants, narcotics, or tranquilizers significantly increase the risk of fatal hypothermia.

    • If you experience dizziness, lightheadedness, chest pain, or palpitations, exit immediately.

    User Health Assessment:

    • Persons with heart disease, circulatory conditions, diabetes, blood pressure abnormalities, respiratory conditions, or open wounds must consult with a healthcare professional prior to using.

  7. ENTRAPMENT AND ENTANGLEMENT HAZARDS
    DANGER – ENTRAPMENT

    • Children, pets, or anyone unfamiliar with cold plunge systems can become trapped, leading to serious injury or death.

    • Keep the tub covered and secured when not in use.

    • Inspect the lid hinges and stay mechanisms. Never remove the lid stay mechanism.

    WARNING – HAIR ENTANGLEMENT

    • Long hair may become entangled in the drain or openings, causing possible drowning or scalp injury.

    • Secure long hair or wear a swim cap; avoid fully submerging your head.

    WARNING – BODY PART ENTRAPMENT

    • Keep limbs and fingers away from drains, filters, or other openings.

    • Regularly inspect and maintain drain covers.

    • If entrapment occurs: Shut off the pump or filtration system immediately and call emergency services if necessary.

  8. ADDITIONAL SAFETY PRECAUTIONS
    Not for Food Storage:

    • This Product is not food-safe.

    • Temperature settings, potential chemical leaching, and lack of sanitary protocols render it unsuitable for storing food or beverages.

    Slippery Surface:

    • WARNING – EXTREMELY SLIPPERY WHEN WET

    • Use non-slip footwear and proceed with caution when entering or exiting.

    • Keep surrounding areas dry and clean spills promptly.

    Regular Inspections:

    • Have a professional regularly check your BoxPlunge tub for safe operating condition.

    • Cease use immediately if any component is damaged (e.g., cords, plugs, drain covers, pump housing). Contact a qualified technician or an authorized service center.

  9. LEGAL DISCLAIMERS
    Limitation of Liability:

    • To the fullest extent permitted by law, BoxPlunge and its affiliates, directors, officers, employees, representatives, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the purchase, installation, or use of the Product.

    No Warranties:

    • Unless explicitly stated in writing, the Product is provided “AS IS” without any warranties or representations, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

    Indemnification:

    • You agree to indemnify, defend, and hold harmless BoxPlunge and its affiliates, employees, and agents from any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees and costs) arising from or related to your use, misuse, installation, or maintenance of the Product, or any violation of this Product Notice or the Terms of Sale.

    No Third-Party Beneficiaries:

    • This Product Notice does not create any third-party beneficiary rights or remedies for any individual or entity that is not a party to this agreement.

    Governing Law and Dispute Resolution:

    • This Product Notice and any dispute arising out of or in connection with the Product shall be governed by the laws specified in the Terms of Sale.

  10. FINAL ACKNOWLEDGMENT
    By purchasing, installing, or using the BoxPlunge Product, you confirm that you have read and voluntarily accept the terms and conditions stated herein, including all warnings, cautions, and disclaimers. If you do not understand or agree to these terms, immediately discontinue use and contact BoxPlunge or an authorized distributor for return information (subject to any applicable return policies).

IMPORTANT: If any portion of this Product Notice is determined to be invalid or unenforceable, the remainder shall remain in full force and effect.
